Por que um Liquidificador Funciona Melhor do que um Jurista?

Resumo: J. Locke forneceu o primeiro modelo de separação de poderes nos tempos modernos em seu segundo Tratado sobre o Governo, no final do século XVII. Seu modelo distinguia os poderes legislativo, executivo e federativo. Sua distinção explica a globalização do direito como ninguém. Lendo os mapas do mundo em 1815, 1871, 1920, 1950, 1990 e hoje, é fácil perceber que a ordem mundial é principalmente uma questão de projeto institucional sistêmico no qual as funções legislativas, alocativas e federativas do direito contribuem para a formação da ordem mundial de uma forma não muito diferente dos designers que projetam tecnologia ou interiores de casas. No entanto, quando o projetista de tecnologia comete um erro, o produto ou serviço é reprojetado e não é implementado nenhum serviço caro e inútil para dar suporte ao projeto errado. Vice-versa, quando um erro de projeto de lei é cometido, geralmente não há redesenho e uma máquina burocrática enorme, cara e ineficaz é implementada para dar suporte ao projeto errado. Este artigo investiga esse estranho fenômeno e fornece um kit de ferramentas para um projeto de lei sistêmico eficaz. Esse conjunto de ferramentas requer uma visão e uma estrutura epistemológica mais sofisticadas para entender a era complexa e turbulenta que está tomando forma, na qual os ventos da construção destrutiva estão soprando e, especialmente, a tecnologia está levando a humanidade a uma era na qual há uma abertura ilimitada para o possível, uma era chamada Gegnet.

Abstract: J. Locke provided the first separation of power model in the Modern Time in his second Treaty on Governemnt at the end of the XVII century. Hismodel distinguished legislative, executive and federative power. his distinctio explains globalization of law like nobody else. reading the maps of the world in 1815, 1871, 1920 , 1950 1990 and today it is easy to realize world order is mostly a matter of systemic institutional design in which legislative-allocative and and federative fnctions of law contribute ro theshaping of the world order in a way not so dfferent from the designe4rs projecting technology or home interiors. Nevertheless when the technology desiger makes a mistake the product or service is redesigned and no expensive and useless service to support the wrong design is impemented. Viceversa , when a law design mistake is made, usually there is no redesign and a huge , expemsive and uneffective bureacratic machine is implemented to support he wrong design. This paperinvestigates this strange phenomenon nd provides atoolkit for effective systemic law design. This toolkit requires arather sophisticated vision and epistemological framework for understanding the complex and turbulent age which is taking shape in which the winds of destructive construction are blowing and especially technology is leading mankind into an age in whic there is an unlimited opening to the possible, an age called Gegnet.
